Welcome to Tabe Restaurant's table booking system operated by 168 Group Inc. These Terms of Service ("Terms") govern your use of our website and table booking services (the "Service").
Please read these Terms carefully before using the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
1. Use of the Service
1.1 Account Registration
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
1.2 Account Security
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
1.3 User Conduct
While using our Service, you agree not to:
- Violate any applicable laws, regulations, or third-party rights
- Use the Service for any illegal or unauthorized purpose
- Attempt to probe, scan, or test the vulnerability of the system or breach any security measures
- Interfere with or disrupt the integrity or performance of the Service
- Make multiple reservations for the same time slot
- Create reservations with false information
- Make reservations on behalf of others without their consent
2. Bookings and Reservations
2.1 Booking Confirmation
Your booking is not confirmed until you receive a confirmation email or message from us. A booking request does not guarantee availability. We reserve the right to decline or cancel bookings at our discretion.
2.2 Cancellation Policy
You may cancel your reservation through our online cancellation system or by contacting Tabe Restaurant directly. Our cancellation policies are:
- Standard Reservations: Free cancellation up to 2 hours before your reservation time
- Omakase Experience: Must be cancelled at least 24 hours in advance to avoid fees
- Large Groups (6+ guests): Must be cancelled at least 24 hours in advance
- Cancellation Method: Use the cancellation link in your confirmation email or visit our website
- Repeated Cancellations: Multiple last-minute cancellations may result in requiring deposits for future bookings
To cancel your reservation online, use the cancellation link provided in your confirmation email or contact us at (734) 987-1688.
2.3 No-Show Policy
Important: To maintain availability for all guests and compensate for lost revenue, we enforce a strict no-show policy:
- Definition: A no-show occurs when you fail to arrive within 30 minutes of your reservation time without cancelling
- No-Show Fee: $50 per person will be charged to the card on file
- Fee Processing: No-show fees are automatically charged approximately 2 hours after your missed reservation
- Grace Period: We hold your table for 15 minutes past your reservation time
- Contact Us: If you're running late, please call (734) 987-1688 immediately
- Disputes: To dispute a no-show fee, contact us within 48 hours with documentation
By making a reservation, you authorize us to charge the no-show fee to your payment method if you fail to honor your reservation without proper cancellation.
2.4 Payment Processing and Security
All payment processing is handled by Stripe, Inc., our PCI Level 1 certified payment processor. When making a reservation, you will be required to provide a valid payment method.
What Stripe Handles:
- All credit/debit card processing and security
- Tokenization of your payment information
- Fraud detection and prevention
- PCI compliance and data security
By providing your payment information, you understand:
- Direct to Stripe: Your card details go directly to Stripe's secure servers and never touch our systems
- We Never See: We cannot access your full credit card number, CVV, or other sensitive payment details
- Card Verification: Stripe performs a temporary $1 authorization to verify your card (automatically released)
- No Upfront Charges: Your card is NOT charged at booking time for standard reservations
- Secure Tokens Only: We only store Stripe's secure tokens and the last 4 digits of your card
- Authorization for Fees: You authorize us to charge applicable no-show or cancellation fees through Stripe
- Deposits: Omakase experiences may require a deposit that will be credited toward your final bill
- Data Security: Stripe maintains PCI DSS Level 1 compliance, SOC 1/2 compliance, and uses AES-256 encryption
2.5 Dispute Resolution
If you believe you have been incorrectly charged:
- Contact us within 48 hours of the charge at hello@168groupusa.com
- Provide your confirmation code and explanation of the dispute
- Include any supporting documentation (medical emergency, etc.)
- We will review and respond within 5 business days
- Legitimate disputes will be refunded promptly
2.6 Late Arrivals
Your table will be held for a maximum of 15 minutes past your reservation time. After this period, the table may be released to other guests. If you are running late, please contact the restaurant directly at (734) 987-1688.
2.7 Seating Requests
While we make every effort to accommodate seating preferences, specific table requests cannot be guaranteed and are subject to availability.
3. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of 168 Group Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of 168 Group Inc.
4. Links To Other Web Sites
Our Service may contain links to third-party websites or services that are not owned or controlled by 168 Group Inc.
We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that 168 Group Inc. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
5. Limitation of Liability
In no event shall 168 Group Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service; and
- Unauthorized access, use or alteration of your transmissions or content,
whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
6. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
168 Group Inc., its subsidiaries, affiliates, and its licensors do not warrant that:
- The Service will function uninterrupted, secure, or available at any particular time or location;
- Any errors or defects will be corrected;
- The Service is free of viruses or other harmful components; or
- The results of using the Service will meet your requirements.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of Michigan, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
